Residency vs. work permits in Panama: why they’re separate processes

Residency (SNM) and work authorization (MITRADEL) are distinct administrative processes in Panama. Know what to check before starting to work.

Residency and work permit procedures Panama

In Panama two administrative processes that are often confused operate side by side: migratory residency (administered by the Servicio Nacional de Migración) and work authorization (administered by the Ministerio de Trabajo y Desarrollo Laboral, MITRADEL). This article explains, in general terms and based on institutional competences, why these are separate procedures and what a foreign national should check before beginning employment in the country.

What Does Panama's National Immigration Service Regulate?

The Servicio Nacional de Migración (SNM) regulates the migratory status of people in Panama: it grants, renews and modifies conditions of temporary, provisional or permanent residence, as well as other acts linked to entry and stay in the territory. The SNM’s competence focuses on determining the applicant’s migratory condition (for example, whether they may remain as a temporary or permanent resident) and issuing the corresponding migratory documents.

What Does MITRADEL Regulate?

The Ministerio de Trabajo y Desarrollo Laboral (MITRADEL) regulates authorizations to work in Panama. Its role is to assess and issue labor permits or authorizations when the law requires an administrative authorization for a foreign national to perform paid work. MITRADEL acts on the employment relationship and the suitability of the foreign national to hold a position under the applicable labor and migration rules.

Residency Does Not Automatically Equal Work Authorization

Having a residence granted by the SNM does not automatically mean the person has the right to work in all cases. There are migratory categories whose holder may exercise work activities and others that may limit work or require an additional labor authorization. That is why it is important to distinguish migratory condition (who the person is and under what status they remain) from labor authorization (whether they can perform paid work and under what conditions).

What Should a Foreign National Check Before Starting Work?

  • Migratory status: review the current residence category and the annotations on the migratory document.
  • Applicable category: determine which work authorization applies based on the person’s immigration category and current regulations.
  • Documentation: confirm that required personal and migratory documentation is valid and in order.
  • Validity: check the dates and temporal conditions of the residence and of any permit you already hold.
  • Need for work authorization: confirm with MITRADEL whether the activity you intend to perform requires a specific permit for foreigners.

Types of Work Permits

MITRADEL handles different categories and modalities of labor authorization for foreigners. Generally, and without exhausting all variants, categories can be found related to:

  • Hiring by a local employer (employment relationship).
  • Temporary hiring or hiring for a specific project.
  • Authorizations for professionals or technicians when the law requires professional validation or registration.
  • Permits linked to special residencies that contemplate economic or labor activity.

Each category has its own criteria that MITRADEL applies according to labor regulations and the applicable migration rules.

What If You Do Not Know Which Category Applies?

If you are not sure which migratory category or work permit applies to you, it will be necessary to evaluate your migratory situation, the purpose of your stay, the work activity you plan and the documentation available. This review makes it possible to identify whether the current residence authorizes work or whether an authorization must be processed with MITRADEL. Frequently Asked Questions

Does Permanent Residency Always Allow You to Work in Panama?

You cannot generally assert that any permanent residence automatically includes a work permit. It will depend on the migratory category and the conditions that the SNM has granted in the migratory file.

Do I Need to Apply for Anything With MITRADEL If I Already Have Temporary Residency?

The applicable work authorization depends on the specific category and current regulations. Before beginning employment, the person should verify whether authorization from MITRADEL is required.

Where Can I Confirm Whether My Activity Requires a Work Permit?

The official guidance and MITRADEL’s assistance are the competent channels to confirm the need for an authorization. It is also advisable to review your migratory condition with the SNM before initiating employment procedures.

Does the Same Application Cover Both Residency and a Work Permit?

Generally they are distinct administrative procedures processed before different authorities: the SNM for residency and MITRADEL for labor authorization. In certain integrated or specific processes both procedures may be related, but they should not be confused.
